Welcome to GuideBeam, operated by GuideBeam Pty Ltd (“GuideBeam”, “we”, “our”, “us”).
These Terms govern your access to and use of the GuideBeam platform, website, and related services.
1. Acceptance of Terms
In short: By using GuideBeam, you agree to these Terms.
By creating an account or using our services, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree, you must not use the platform.
2. Eligibility and Accounts
In short: You must be old enough and responsible for your account.
- You must be at least 16 years old or have parental or institutional consent.
- Provide accurate information and keep your password secure.
- Accounts are personal and non-transferable.
- We may suspend or terminate accounts that violate these Terms.
3. Use of the Service
In short: Use GuideBeam responsibly and for its intended purpose.
GuideBeam provides tools for self-discovery, career guidance, psychometric assessments, learning pathways, and peer collaboration.
You agree not to:
- Misuse or interfere with the platform,
- Attempt unauthorised access or modification,
- Upload illegal or harmful content,
- Reverse-engineer or copy our systems.
We may collect anonymised usage metrics (navigation, completion rates, session duration) to improve design and performance.
4. Psychometric Instruments
In short: Some tests belong to their creators.
Certain assessments (e.g. CABIN-NET, HEXACO) are the intellectual property of their respective authors or institutions.
GuideBeam uses them under licence, permission, or fair-use provisions and does not claim ownership.
We may substitute or remove instruments as required.
5. AI-Generated Insights and Data Access
In short: Our AI tools help you reflect, but you make the decisions.
- AI features such as résumé suggestions, interview simulations, and career recommendations are for informational and educational purposes only.
- Outputs are generated algorithmically and should be reviewed before use.
- GuideBeam is not liable for outcomes based on AI content.
Access by Professionals, Enterprises, and Educational Institutions
- Users may explicitly authorise psychologists, counsellors, employers, HR departments, or schools (“Enterprise Accounts”) to access parts of their data.
- Sharing occurs only with consent and can be revoked at any time.
- GuideBeam acts solely as a data conduit and is not responsible for how third parties interpret or use shared data.
- Educational Institutions must ensure parental or guardian consent for minors and comply with privacy and child-protection laws.
GuideBeam may later offer separate written enterprise agreements that override these Terms where expressly agreed in writing.
6. Peer Pods and Community Conduct
In short: Be respectful; you’re responsible for what you share.
- Peer Pods are collaborative learning spaces.
- No harassment, hate speech, impersonation, or spam.
- GuideBeam may moderate or remove users to maintain safety.
- You’re responsible for your own content; we’re not liable for user-generated material.
- Peer interactions are not professional advice.
7. Payments and Billing
In short: Stripe handles payments securely.
Payments are processed through Stripe Payments Australia Pty Ltd.
- By paying, you agree to Stripe’s Terms and Privacy Policy.
- GuideBeam does not store full credit-card details.
- Prices are in AUD and include applicable taxes.
- Refunds follow Australian Consumer Law.
8. Intellectual Property and Third-Party Data
In short: We own GuideBeam; you own your data.
- GuideBeam, its logo, algorithms, and content are © GuideBeam Pty Ltd.
- You retain ownership of your information but grant us a non-exclusive, worldwide, royalty-free licence to process it to operate and improve the service.
Third-Party Data Sources
GuideBeam incorporates information from O*NET, Lightcast, and other providers.
Their data remains their IP and is used under public or API terms.
Users may not reproduce or redistribute such data outside GuideBeam.
9. Promotions and Advertising
In short: You may see relevant offers, never intrusive ads.
GuideBeam may show or email career-related partner content.
We do not sell user data or permit behavioural advertising.
Promotions will be clearly labelled, and you can opt out of marketing emails.
10. Limitation of Liability
In short: We do our best, but can’t promise perfection.
GuideBeam is provided “as is” without warranties.
We’re not liable for indirect or consequential losses, including career or employment outcomes.
Our total liability is limited to the amount you’ve paid in the previous 12 months.
11. Termination
In short: Either of us can end this relationship.
You may close your account at any time.
We may suspend or delete accounts for misuse or breach.
After termination, your right to use GuideBeam ceases immediately.
12. Governing Law and Dispute Resolution
In short: ACT (Australia) law applies.
These Terms are governed by the laws of the Australian Capital Territory.
Both parties will attempt good-faith resolution before litigation.
Unresolved disputes fall under the exclusive jurisdiction of ACT courts.
